Compensation in Wrongful Death Cases
A wrongful death case is a unique legal process, as it must be filed by someone who was close to the decedent. In Pennsylvania, the only people permitted to make a wrongful death claim are those who are personal representatives of the decedent’s estate. If no one was named before the decedent’s passing, it is likely the court will name a spouse, parent, or child as the representative. The claim must also be filed within two-years of the decedent’s passing, not necessarily since the date of the accident or incident that led to their death.
The compensation the representative can name in the wrongful death claim include:
- Final hospitalization: All medical fees related to the final hospitalizations and emergency treatment the decedent required.
- Burial and funeral costs: Any expenses related to burying the decedent and organizing a funeral should be covered by the liable party.
- Lost wages: The immediate family of the decedent can collect monetary compensation equal to what the decedent would have likely earned throughout their lifetime had the accident never occurred. This amount is usually based on a 6- or 12-month average calculated from the last 6-months of the decedent’s life.
- Missing companionship: Surviving family members that were close or dependent on the decedent can also cite missing companionship or consort as a damage of their wrongful death. This acts as a form of nominal damages and will vary from case to case but it can sometimes be the largest amount collected in a settlement or verdict.
