The Telephone Consumer Protection Act was passed in 1991. This act was designed to regulate unwanted telemarketing calls, junk faxes, and other unwanted calls to people's residences and their cellular phones.
Under the TCPA, those making calls (including robo callers) are required to do the following:
- Limit the calls to the hours of 8 A.M. and 9 P.M
- Maintain a "do not call list" and honor any request to be placed on such list
- Have a clearly written policy that is available upon request
- They must have a clearly defined training program for the personnel making such telephone calls
In addition to the above, the TCPA prohibits the use of artificial or prerecorded voice messages to call a residence except in the cases of an emergency, or if the caller has received prior consent. Furthermore, under the TCPA, anyone using an autodialer or an artificial prerecorded voice message to call any number must state their identity at the beginning of the message. They are also required to give their address and phone number during the call.
